Apostilės (pagal
Hagos Konvenciją)
Lietuvos Respublika ir Jungtinės Amerikos
Valstijos yra prisijungusios prie 1961 m.
Hagos konvencijos dėl užsienio valstybėse išduotų dokumentų legalizavimo
panaikinimo. Sutinkamai su ja, valstybių įgaliotos
institucijos specialia pažyma (apostile) gali paliudyti dokumente esančio
parašo tikrumą, dokumentą pasirašiusio asmens pareigas ir, kai reikia,
dokumente esančio antspaudo arba ženklo tapatumą. Tokia pažyma (apostile)
patvirtinti dokumentai kitoje Hagos konvencijoje dalyvaujančioje valstybėje
yra priimami be diplomatinio ar konsulinio legalizavimo.
Pavyzdžiui, tam, kad JAV išduotą gimimo
(santuokos, mirties) liudijimą būtų galima pateikti oficialioms
institucijoms Lietuvoje arba kitose Hagos Konvencijos valstybėse, jį reikia
patvirtinti minėta pažyma (apostile) ir, kai reikalaujama, pridėti notariškai
patvirtintą vertimą.
Kuriais atvejais užsienyje išduotų dokumentų
tvirtinimas apostile yra būtinas? Įvairūs Lietuvos Respublikos teisės aktai
nusako konkrečius atvejus, kai Lietuvoje pateikiami dokumentai turi būti
legalizuoti (Hagos konvencijos valstybių atveju - patvirtinti apostile).
Pavyzdžiui, Notariato įstatymas numato, jog Lietuvos notarams pateikiami užsienyje
išduoti dokumentai turi būti legalizuoti (patvirtinti apostile). Taip pat
turi būti legalizuoti (patvirtinti apostile) užsienyje išduoti dokumentai, pateikiami Lietuvos
teismams, o taip pat dokumentai, pateikiami Migracijos departamentui, kai nagrinėjami pilietybės, pasų, leidimų gyventi
Lietuvoje klausimai.
Jeigu nesate įsitikinę, ar tam tikro JAV išduoto
dokumento tvirtinimas apostile yra būtinas, pasitikslinkite tai Lietuvos
įstaigoje, kuriai pateiksite šį dokumentą. Kai kurie dokumentai, pavyzdžiui, pasai,
vairuotojo pažymėjimai, komercinės sutartys, apostile netvirtinami.
Apostile gali būti tvirtinamos ir notariškai
patvirtintos dokumentų kopijos. Tokiu atveju apostilė paliudys
tik kopiją
tvirtinusio notaro parašo tikrumą, tačiau
ne dokumentą pasirašiusio pareigūno parašo tikrumą. Bet kuriu atveju dokumento tvirtinimas apostile liudija tik parašo tikrumą, dokumentą pasirašiusio asmens pareigas
arba dokumente esančio antspaudo arba ženklo tapatumą, tačiau netvirtina
dokumente išdėstytų faktų tikrumo.
Lietuvoje išduotus dokumentus apostile tvirtina tik Lietuvos Respublikos užsienio reikalų ministerija,
J.Tumo-Vaižganto g. 2, 105 kabinetas, LT-01511 Vilnius, priėmimo valandos:
9-12 val. (darbo dienomis), telefonas pasiteiravimui: +3705 2362 613.
Lietuvos Respublikos diplomatinės ir konsulinės įstaigos neturi teisės
apostile tvirtinti dokumentų.
Dėl JAV išduotų dokumentų tvirtinimo
apostile rekomenduojama susisiekti su atitinkama žemiau nurodyta JAV
institucija ir pasitikslinti, ar konkretaus dokumento tvirtinimas įeina į
jos kompetenciją, ar nėra reikalaujama papildomo dokumento tvirtinimo
atitinkamos valstijos teismo įstaigose ir kt.
